A man and woman were arrested and presented in court for allegedly failing to protect a 14-year-old child against cultural rights.

The woman identified as Ether Nzilani is alleged to have married off her daughter to Joseph Mutinda who is her boyfriend.

“Esther married her daughter off to Mutinda who in return promised to take care of her basic needs as well as paying of school fees,” a police officer told the court in a sworn affidavit.

It was then alleged that Mutinda rented a house for the minor and went on to inform the landlord that the child was his wife.

Further in the affidavit, Mutinda is claimed to have defiled the minor on several occasions whenever he visited her at the rental house.

The officer further disclosed that the minor was later rescued by Nyumba Kumi officers who took the child to the children office where medics from MSF took her for examinations. Esther and Mutinda were arrested on January 5.

Mutinda, however, told the court that he felt offended having been accused of defiling the child

“Your honour, Esther is like my wife now having cohabited with her for two years. I cannot go after her daughter,” Mutinda to the court.

Adding: “I received a call from my wife asking me to help her daughter get a house since her aunt who was then living with her was travelling upcountry. I decided to get her a room. Two weeks later while at my place of work, I was ambushed by Nyumba Kumi members while sipping soup with the minor and taken to Industrial area police station,” said a distraught Mutinda.
