Millionaire city couple accuse each other of using juju to ‘steal’ property

A man and a woman living in Nairobi’s posh Karen estate are entangled in a shocking divorce case.

Haron Michael Mwaura wants his alleged marriage to Margaret Karimi Mbaka, a manager of seven top companies in the region, dissolved.

In court documents seen by The Nairobian, Mwaura claims he suspected Margaret was having ‘a thing’ with another man and that his wife of more than two decades had started changing the status of some of the multi-million shilling properties they jointly own.

He also asked the court to restrain Margaret from throwing him out of the house or transferring properties they co-own until the court decides on the matter.

In a responding affidavit, Margaret, who is the managing director of Dalbit Energy, disputes Mwaura’s claims. According to her, she was never married to Mwaura, explaining that they were in an intimate relationship, only to later discover that he (Mwaura) was engaging in witchcraft.

Mwaura however, in his affidavit says: “I’ve been married to the respondent for more than 20 years, and we have been living in our Karen matrimonial home since our marriage was solemnised.”

He further added that: “During the pendency of the marriage, we have worked together and jointly bought properties and shares in various companies in Kenya, Mauritius and Cyprus.”

In her replying affidavit dated May 10, Margaret responded that: “The petitioner and I had not met by and did not know each other in 1998, my two sons are not his biological children, and have never been regarded as such, and the petitioner and I have intermittently visited each other and taken holidays but never lived together.”

Refrigerator technician

She goes ahead to reveal that she met Mwaura in 2007 while he was a refrigerator technician in what led to an on and off intimate friendship and they later became business partners. Margaret says they formed a company that was incorporated in 2014, but they have never lived together as husband and wife.

She claims that she never contemplated marriage or any customary rites to be conducted between her and the petitioner.

Mwaura is accusing Margaret that she started transferring tittles and ownership of their matrimonial properties without his knowledge to defeat his matrimonial rights, including transferring their Karen homes to one of her sons.

In the sworn affidavit dated April 26, Mwaura alleges that: “On the 7th April 2018, the respondent used police officers to invade our Karen home and forcefully evicted me in the middle of the night.”

He further claims that Margaret was in the company of a man who claimed to be the Karen OCS and was there to enforce a court order which he didn’t show him while threatening to execute arrest.

“After I was forcefully evicted, I was left in the cold and had no recourse but to seek refuge in our other home in Kibiko, Ngong, but on 12th April, the respondent called me since I was not around at the time and informed me that I was to be in Kibiko in less than 10 minutes lest I faced unspecified consequence,” he stated.

Upon arrival, Mwaura claims that he found Margaret and the said officer among other cops who ordered him to retrieve all the documents relating to their properties from the house, after which she “confiscated and set them on fire.”

Also destroyed, according to Mwaura, were his clothes, photo albums and academic papers. He says one of his vehicles was impounded by the OCS whom he suspects is having an affair with Margaret.

He further swore that: “I have on several occasions noticed strange vehicles and people trailing me, and I verily believe they are out to cause me harm and under instructions from the respondent.”

He added that: “The respondent has engaged and compromised police officers who have on both occasions while evicting me, threatened to kill and silence me. After reporting the death threats at both Karen and Ngong police stations, no action has been taken, which has made me quite pensive about my personal safety”


But Margaret has denied destroying Mwaura’s property, stated that she found out he was a married man with three children. She swore that at one time after a disagreement, he wrote an email describing her as just a friend.

She further swore that: “I also learnt in dismay that he was involved in witchcraft in order to make me and my sons lose sanity and hand over all assets to him.”

Margaret adds that she doesn’t own any property in Mauritius and Cyprus as alleged by Mwaura. She stated that the motor vehicle is an asset of the company known as Supa Soko Bargains that was incorporated in 2014, and which they are both directors.

She said that there is a contractual agreement that the vehicle be held as security for the repayment of a Sh4.1 million loan owed to Margaret by the company in question, thus Mwaura had no rights to it.

She wants the case dismissed and Mwaura made to foot the costs.
